Health Insurance Portability (HIPAA) Compliance

The Health Insurance Portability and Accountability Act (HIPAA) were enacted by the U.S. Congress in 1996. HIPAA is designed to provide privacy standards to protect patients’ medical records and other health information supplied to health plans, doctors, hospitals and other healthcare entities.

The law covers three areas:

  • Privacy of medical records, regardless of media type
  • Security of protected health information (PHI) in electronic form
  • Administrative simplification of electronic data

Information security considerations are involved throughout the HIPAA rules and in particular play a major role in the Privacy Rule. This rule serves to help protect personally identifiable information (PII) as it moves through the healthcare system. Healthcare organizations, including providers, payers and clearinghouses, must comply with the Privacy Rule.

Extending HIPAA’s coverage, the Health Information Technology for Economic and Clinical Health (HITECH) Act of 2009 addresses third-party access to PHI, increases compliance obligations and strengthens enforcement penalties.

Importance of Adhering to HIPAA Compliance

To help healthcare organizations comply with HIPAA, security standards have been created to help organizations protect personally identifiable information (PII). These standards encompass administrative procedures, technical security mechanisms and services, and physical safeguards. Security standards compliance and overall HIPAA compliance outlined by the Act is imperative to the ongoing business operations of healthcare organizations. Failure to comply may not only result in regulatory actions, such as fines, but also loss of business, damage to reputation and loss of the public’s trust.
